and \ldblquote Film classification body\rdblquote means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).\par \pard\ltrpar\par \ul\b Door Supervision\par \pard\ltrpar\fi-360\li360\sb120\qj\tx360\ulnone\b0 7.\tab Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, that licence must include a condition that each such individual must:\par \pard\ltrpar\fi-360\li720\sb120\qj\tx360 (a)\tab Be authorised to carry out that activity by a licence granted under the Private Security Industry Act 2001;\par \pard\ltrpar\fi-360\li720\sb120\qj (b)\tab Be entitled to carry out activity by virtue of section 4 of the Act.\par \pard\ltrpar\fi-720\li720\sb120\qj\tx360\par \pard\ltrpar\fi-360\li360\sb120\qj\tx360 8.\tab But nothing in subsection (1) requires such a condition to be imposed:\par \pard\ltrpar\fi-360\li720\sb120\qj\tx360\tx720 (a)\tab In respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c.12) (premises with premises licences authorising plays or films); or\par \pard\ltrpar\fi-360\li720\sb120\qj (b)\tab In respect of premises in relation to:\par \pard\ltrpar\fi-360\li1080\sb120\qj\tx360\tx1080 (i)\tab Any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or\par \pard\ltrpar\fi-360\li1080\sb120\qj (ii)\tab Any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).\par \pard\ltrpar\fi-720\li720\sb120\qj\tx360\tx1080\cf0\par \pard\ltrpar\fi-720\li720\qj\tx360 9.\tab For the purposes of this section:\par \pard\ltrpar\fi-360\li1080\sb120\qj\tx360\tx1080 (a)\tab\ldblquote Security activity\rdblquote means an activity to whic\cf1 h paragraph 2(1)(a) of that Schedule applies, and which is licensable conduct for the purposes of that Act.\par (b)\tab Paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.\cf0\par \pard\ltrpar\cf1\b\par \ul Age Verification\par \pard\ltrpar\fi-360\li360\qj\ulnone\b0 10.\tab The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. \par \pard\ltrpar\li360\par \pard\ltrpar\fi-360\li360\qj 11.\tab The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.\par \pard\ltrpar\li360\cf0\par \pard\ltrpar\fi-360\li360\qj\cf1 12.\tab The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either:\par \pard\ltrpar\li360\par \pard\ltrpar\li720 (a)\tab a holographic mark, or\par (b)\tab an ultraviolet feature.\par \pard\ltrpar\par \ul\b Permitted Price\par \pard\ltrpar\fi-360\li360\qj\cf0\ulnone\b0 13.\tab A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.\par \pard\ltrpar\li360\par \pard\ltrpar\fi-360\li360 14.\tab For the purpose of this condition set out in paragraph 1:\par \pard\ltrpar\li1440\par \pard\ltrpar\fi-360\li720\qj (a)\tab ''duty'' is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(6);\par \pard\ltrpar\li720\par \pard\ltrpar\fi-360\li720\qj (b)\tab ''permitted price'' is the price found by applying the formula-\par \pard\ltrpar\par \pard\ltrpar\fi720 P = D + (D X V)\par \pard\ltrpar\fi720\li720\par Where:\par \par \pard\ltrpar\fi-720\li2160 (i)\tab P is the permitted price,\par \pard\ltrpar\li720\par \pard\ltrpar\fi-720\li2160\qj (ii)\tab D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and\par \pard\ltrpar\li720\par \pard\ltrpar\fi-720\li2160\qj (iii)\tab V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;\par \pard\ltrpar\li720\par \pard\ltrpar\fi-425\li851\qj (c)\tab 'relevant person'' means, in relation to premises in respect of which there is in force a premises licence -\par \pard\ltrpar\li1440\par \pard\ltrpar\fi720\li720 (i)\tab the holder of the premises licence,\par \pard\ltrpar\fi-687\li2127 (ii)\tab the designated premises supervisor (if any) in respect of such a licence, or\par \pard\ltrpar\fi-675\li2115 (iii)\tab the personal licence holder who makes or authorises a supply of alcohol under such a licence;\par \pard\ltrpar\li720\par \pard\ltrpar\fi-425\li916\qj (d)\tab ''relevant person'' means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and\par \pard\ltrpar\li491\qj\par \pard\ltrpar\fi-425\li785\qj (e)\tab ''value added tax'' means value added tax charged in accordance with the Value Added Tax Act 1994(7).\par \pard\ltrpar\lang1033\b\par \pard\ltrpar\fi-360\li360\qj\b0 15.\tab Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.\par \pard\ltrpar\b\par \pard\ltrpar\fi-360\li360\qj\b0 16.\tab (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of\b \b0 paragraph 2 on a day (\ldblquote the first day\rdblquote ) would be different from the permitted price on the next day\b \b0 (\ldblquote the second day\rdblquote ) as a result of a change to the rate of duty or value added tax.\lang2057\par \pard\ltrpar\lang1033\par \pard\ltrpar\li360\qj (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.\lang2057\par \pard\ltrpar\cf1\par \par \ul\b Irresponsible Drink Promotions (applicable to \lquote on\rquote & \lquote off\rquote sales)\par \pard\ltrpar\fi-360\li360\qj\ulnone\b0 17.\tab The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. \par \pard\ltrpar\li360\par \pard\ltrpar\fi-360\li360\qj 18.\tab In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises:\par \pard\ltrpar\li360\par \pard\ltrpar\fi-360\li720\qj (a)\tab games or other activities which require or encourage, or are designed to require or encourage, individuals to:\par \pard\ltrpar\li720\par \pard\ltrpar\fi-720\li1440\qj (i)\tab drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or\par \pard\ltrpar\li1440\par \pard\ltrpar\fi-720\li1440\qj (ii)\tab drink as much alcohol as possible (whether within a time limit or otherwise).\par \pard\ltrpar\par \pard\ltrpar\fi-360\li720\qj (b)\tab provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;\par \pard\ltrpar\li720\par \pard\ltrpar\fi-360\li720\qj (c)\tab provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;\par \pard\ltrpar\li720\cf0\par \pard\ltrpar\fi-360\li720\qj\cf1 (d)\tab selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;\par \pard\ltrpar\li720\cf0\par \pard\ltrpar\fi-360\li720\qj\cf1 (e)\tab dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).\par \pard\ltrpar\b\par \pard\ltrpar\fi-360\li360\qj\b0 19.\tab The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.\par \pard\ltrpar\par \ul\b Alcoholic Drink Measures\par \pard\ltrpar\fi-360\li360\ulnone\b0 20.\tab The responsible person must ensure that:\par \pard\ltrpar\li360\par \pard\ltrpar\fi-360\li720\qj (a)\tab where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-\par \pard\ltrpar\par \pard\ltrpar\fi-720\li1440 (i)\tab beer or cider: \'bd pint;\par (ii)\tab gin, rum, vodka or whisky: 25 ml or 35 ml; and\par (iii)\tab still wine in a glass: 125 ml;\par \pard\ltrpar\par \pard\ltrpar\fi-360\li720\qj (b)\tab these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and\par \pard\ltrpar\par \pard\ltrpar\fi-360\li720\qj (c)\tab where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.\rdblquote\par \pard\ltrpar\cf0\f2\fs24\par \pard\ltrpar\qj\ul\b\f0\fs20 Conditions Consistent with the Applicant\rquote s Operating Schedule\ulnone\b0\par \par \b General\par \b0\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 All staff will be trained in relation to the sale of age restricted goods.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 A CCTV system will operate at the store.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 An age recognition scheme such as Challenge 25 will be in place.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 A register of all challenged and refused sales will be maintained.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 A register of all major incidents of crime and disorder will be maintained.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 A system of prompts will be in place to ensure staff undertake age checks on age restricted products.\par \pard\ltrpar\qj\par \b The Prevention of Crime and Disorder\par \b0\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 CCTV shall be installed to specifications agreed with Leicestershire Constabulary and maintained in accordance with the Information Commissioners Code of Practice. The CCTV shall record at all times premises are open for a licensable activity. All images held are to be made available on request by any of the responsible authorities.\par \par \f3\'b7\tab\f0 A Register of all major incidents of crime and disorder will be kept.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 The premises will be fitted with an industry standard approved Intruder Alarm System.\par \pard\ltrpar\qj\par \b Public Safety\par \b0\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 The requirements of the Fire Officer will be complied with.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 A Fire Risk Assessment will be undertaken prior to the premises trading.\par \pard\ltrpar\qj\par \b The Prevention of Public Nuisance\par \b0\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 A regular litter pick of the stores external areas will be carried out.\par \pard\ltrpar\qj\par \pard\ltrpar\li360\qj\b The Protection of Children from Harm\par \pard\ltrpar\qj\b0\par \pard\ltrpar\fi-360\li720\qj\tx720\f3\'b7\tab\f0 Training will be provided for all staff before they are allowed to sell alcohol and will include the company age recognition scheme, proof of age, how to refuse a sale, how to deal with conflict proxy sales and refusals records. The training will be documented. The Designated Premises Supervisor will check that the training has been understood. The training will be repeated at least every 6 months. Records of training will be provided to the Responsible Authorities and the Licensing Authority on request.\par \par \f3\'b7\tab\f0 An age recognition scheme such age Challenge 25 will be in place.\par \par \f3\'b7\tab\f0 A system of prompts will be in place to ensure staff undertake age checks on age restricted products.\par \par \f3\'b7\tab\f0 An up to date record of challenged and refused sales of alcohol, indicating the date, time, reason and person refusing will be made available for inspection by any Responsible Authority. The record will be reviewed at least once a month by the Designated Premises Supervisor. The person carrying out the review shall look for patterns and inconsistencies that may indicate that an individual is not complying with the system or that additional support is required at certain times of the day. The reviewer shall sign and date the record once checked and record any action taken as a result of the review.\par \pard\ltrpar\f4\fs16\par } "
