MANDATORY CONDITIONS APPLICABLE TO ALL PREMISES LICENCES & CLUB PREMISES CERTIFICATES UNDER THE LICENSING ACT 2003
Supply of Alcohol
1. No supply of alcohol may be made under the premises licence:
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Exhibition of Films
3. Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
4. Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
5. Where-
(a) The film classification body is not specified in the licence, or
(b) The relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
6. In this section “Children” - means persons aged under 18; and “Film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).
Door Supervision
7. Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, that licence must include a condition that each such individual must:
(a) Be authorised to carry out that activity by a licence granted under the Private Security Industry Act 2001;
(b) Be entitled to carry out activity by virtue of section 4 of the Act.
8. But nothing in subsection (1) requires such a condition to be imposed:
(a) In respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c.12) (premises with premises licences authorising plays or films); or
(b) In respect of premises in relation to:
(i) Any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or
(ii) Any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).
9. For the purposes of this section:
(a) “Security activity” means an activity to which paragraph 2(1)(a) of that Schedule applies, and which is licensable conduct for the purposes of that Act.
(b) Paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.
Age Verification
10. The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
11. The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
12. The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either:
(a) a holographic mark, or
(b) an ultraviolet feature.
Permitted Price
13. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
14. For the purpose of this condition set out in paragraph 1:
(a) ''duty'' is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(6);
(b) ''permitted price'' is the price found by applying the formula-
P = D + (D X V)
Where:
(i) P is the permitted price,
(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) 'relevant person'' means, in relation to premises in respect of which there is in force a premises licence -
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) ''relevant person'' means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) ''value added tax'' means value added tax charged in accordance with the Value Added Tax Act 1994(7).
15. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
16. (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
Irresponsible Drink Promotions (applicable to ‘on’ & ‘off’ sales)
17. The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
18. In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises:
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to:
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise).
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
19. The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
Alcoholic Drink Measures
20. The responsible person must ensure that:
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.”
A The mandatory conditions, the conditions offered by the Applicant, the conditions consistent with the Operating Schedule and the embedded restrictions on the use of the premises; and
B The following conditions as attached by the Licensing Sub-Committee as a result of this hearing:
Training shall be provided to all staff prior to the date of the event in respect of all age-restricted products sold; this shall include underage alcohol sales, drug awareness, health and safety and fire safety in line with relevant legislation and any systems or procedures they are expected to follow in the course of dealing with these goods;
A refresher briefing shall delivered to all staff prior to the bars opening on the day of the event;
Records detailing the initial training and refresher briefing provided shall be kept on the premises and be· made available upon a request by a Police Officer and/or an authorised officer as detailed within Section 13 of the Licensing Act 2003;
The only acceptable forms of identification shall be:
Photo Driving Licence;
Current Passport;
Any approved Government Card showing the 'PASS' logo; and/or
MoD Identity Card
Clear, prominent and unobstructed signage informing customers of the 'Challenge 25' proof of age scheme in operation shall be displayed at:
All pick up points
Clear, prominent and unobstructed signage informing customers of the 'Challenge 21' proof of age scheme in operation shall be displayed at:
All entry points to the site
Points of sale
A system of recording sales refused under the proof of age scheme shall be operated at all times;
A refusal book/ log (electronic or otherwise) shall be located at each bar area close to the till point. This log / book shall be kept on the premises and be made available upon a request by a Police Officer and/or an authorised officer as detailed within Section 13 of the Licensing Act 2003;
The Designated Premises Supervisor shall ensure that an incident log is maintained within the premises and details of all known incidents are recorded within the log. This log shall be kept on the premises for the duration of the event and made available thereafter for a period of 12 months upon request by a Police Officer and/or an authorised officer as detailed within Section 13 of the Licensing Act 2003;;
Suitable and sufficient written risk assessments covering the Venue, Fire and Operating policies shall be kept up to date and shall be made available upon a request by a Police Officer and/or an authorised officer as detailed within Section 13 of the Licensing Act 2003;
Additional written risk assessments should be undertaken upon request from any relevant authority and agreed and readily available in writing at least 14 days prior to the event.
Marshals shall be on site and at all site entrances to assist in traffic management into and off the site; as well as parking on the site. The marshals / stewards shall monitor all zones of the site at all times for the period of the event / premises licence;
SIA registered door supervisors shall be on site during the period of the licence/event. Numbers of door staff required will be based on a Risk Assessment relating to the number of tickets sold prior to the event and agreed in writing with the Police at least 14 days prior to the event.
All SIA staff, event marshals and the event organisers shall be linked by way of two-way radio or similar device or devices (not by way of mobile phone only);
Landlines should be available on site in the event of an emergency;
All SIA registered staff shall display their SIA registration cards at all times when carrying out security roles within the site and/or at pick up/drop off points;
All SIA staff and marshals shall wear suitable clothing such as fluorescent jackets or bibs to clearly indicate their different roles on site; SIA staff should wear one colour and marshals another to distinguish between the two;
Up to date Risk Assessments are to be in place and adhered to; this is to be kept with the licence at all times when licensable activities are taking place and made available to authorised officers on request. All risk assessments should be agreed with the relevant Relevant Authorities at least 14 days prior to any event taking place;
The premises licence holder shall ensure that it is made clear to promoters, staff, and those persons attending the event, that 'legal highs' shall not be permitted on to the festival/event site;
The premises licence holder shall devise a policy in relation to the way that illegal substances (including drugs) shall be dealt with. This policy shall detail the procedures for searching those attending the festival and the method by which any illegal substances shall be securely stored and/or disposed of (including the operation of the 'Drugs Amnesty Box'). This policy will be adhered to at all times that the premises licence authorises licensable activities for the event;
There shall be provided a 'Drugs Amnesty Box' where those persons attending the festival will be invited to voluntarily surrender any illegal substances or 'legal highs' that they may have in their possession;
The Premises Licence Holder shall devise and adhere to a policy detailing the way in which persons ejected from the site during the event will be dealt with. This policy shall have particular regard to those persons that may be under the influence of alcohol or other substances or that may be under the age of 18 or otherwise vulnerable;
Alcohol and other drinks shall only be served and consumed in cans/plastic/polycarbonate drinking vessels.
All proposed events should be notified to Relevant Authorities as soon as possible and in any event not later than 12 weeks prior to the proposed date.
All artists performing at any event should be notified to the Police at least 8 weeks in advance of the event to enable the relevant checks to be undertaken;
The Licensee shall ensure all residents in the vicinity of an event are notified at least twice prior to any event. Residents meetings shall be arranged where deemed appropriate.
The Licensee shall consult with the public and parish councils at least 8 weeks prior to any event;
The Licensee shall ensure there is a contact number or email for residents to raise any concerns prior to and during the event.
The planning period for the festival is approximately 6 months.
The Premises Licence Holder will discuss all aspects of the event including the promotion of the four licensing objectives under the Licensing Act 2003 with all relevant authorities of the Safety Advisory Group (or its equivalent).
The Event Manual is a work in progress throughout the planning process. It will also contain relevant risk assessments implemented by the Premises Licence Holder to deliver the festival.
The Event Safety Plan shall be prepared in consultation with the Safety Advisory Group (or its equivalent) and a final copy lodged with the Licensing Authority no less than 14 days before the event.
The final licensed plans shall be those plans included with the Event Safety Plan.
The prevention of crime and disorder
The Event Manual will contain details on the following subjects:
• securing the site/protecting the public during set up;
• site access permissions;
• details regarding the Security Manager and Safety Officer (employed during the festival);
• details regarding points of sale of alcohol;
• Security Officer and Stewards' duties;;
• Security Personnel - outline of entry conditions;
• operational plan for the festival;
• details of procedure for dealing with any unrest/disorder;

Training shall be provided to all staff on commencement of the event relating to all age-restricted products sold; this shall include under•age alcohol sales, drug awareness, health and safety and fire safety in line with relevant legislation and any systems or procedures they are expected to follow in the course of dealing with these goods;

16. The premises licence holder shall ensure that it is made clear to promoters, staff, and those persons attending the event, that 'legal highs' shall not be permitted on to the festival site;
17. The premises licence holder shall devise a policy in relation to the way that illegal substances

Public safety
The Event Manual will contain details of the following subjects for each event:
General site safety;
Securing the site and protecting the public during set up;
Outlining dangers to contractors working on the site;
Details of barriers to the perimeter of the licensed area;
Details of electrical systems and installation;
Power requirements;
Location of generators;
Details with regard to back stage areas (if appropriate);
Details on escape lighting (if appropriate);
First aid and fire safety equipment provisions;
Crowd safety operational plan;
Operational plan for festival;
Details of procedure for dealing with any public unrest/disorder;
A Fire Risk Assessment will also be produced for each festival.
The Event Management Plan will contain the following for each event:
Alcohol Management Plan;
CDM Construction Phase Plan;
Counter Terrorism Briefing;
Coach Travel Plan;
Emergency Announcements;
Emergency and Major Incident Planning;
Event Management Structure;
Event & Site Structure;
Evictions Plan;
Evacuation Plan;
Extreme Weather Action Plan;
Fire Risk Assessment and Safety Plan;
Medical Plan;
Noise Management Plan;
Risk Assessments;
Security Operations Plan;
Set It Off Policy;
Show Stop Procedure;
Sign Off to Opening;
Site Plan;
Site Induction and Site Safety Rules;
Traffic Management Plan
Consultation Plan which includes contact details where concerns can be raised.
All events shall be restricted to a maximum of 7000 tickets;
All events should have a dedicated police presence where appropriate by the Police;
A complete Event Management Plan should be made available to all Relevant Authorities at least 12 weeks prior to any proposed event;
All proposed events should be notified to the Highways Authority at least 12 weeks prior to the date of the proposed event;
The Traffic Management plan should identify and include an alternative ingress/egress route that can be utilised in the event of an emergency or upon request from the Highways Authority as appropriate.
An event will not take place without the consent/approval of all Relevant Authorities that attend the SAG in writing at least 14 days prior to the date of any event.
The Event Management Plan and any other documentation relevant to any event shall be kept on site to be available upon request by a Police Officer and/or authorised officer for the duration of the event and for 12 months thereafter.
The prevention of public nuisance
The Event Manual will contain details on the following subjects for each event:
Refuse collection;
Sanitary provisions;
Control of noise levels during the festival, particularly from any amplified music.
The Event Management Plan shall include a consultation plan detailing how members of the public can make contact to raise concerns both prior and during the event.
The protection of children from harm
Access to the site will be with a valid ticket only;
The Event Manual will contain details of:
o Lost and found procedure for vulnerable persons / young adults
o Notices in the alcohol licensed area regarding the law and underage drinking
o A Challenge 25 Policy will be in place at pick up points and a challenge 21 at all ingress points and points of sale;
o Bar staff training and any dangers to vulnerable persons / young adults should be delivered before the dates of event and on the day of any event.
