Additional Non-Standard Timings
To permit the premises to open for licensable activities to show the broadcast of televised sporting events of national or international interest outside normal operating hours, such opening times for this purpose to be confirmed upon 14 days prior notice in writing to the Police before the premises intend to open, such notification to include the opening times and the sporting event which is to be shown.
Mandatory conditions where licence authorises supply of alcohol
(1) No supply of alcohol may be made under the premises licence-
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Mandatory conditions which came into force on 6 April 2010
1. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
Mandatory conditions which come into force on 1 October 2010
4. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Mandatory conditions which came into force 28 May 2014
1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2. For the purposes of the condition set out in paragraph 1-
(a)“duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(6); .
(b)“permitted price” is the price found by applying the formula- .
where-
(i) P is the permitted price,
(ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c)“relevant person” means, in relation to premises in respect of which there is in force a premises licence-
(i)the holder of the premises licence,
(ii)the designated premises supervisor (if any) in respect of such a licence, or
(iii)the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d)“relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e)“valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994(7).
3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
4. (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
Mandatory Condition: Exhibition of Films
The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made
a) By the British Board of Film Classification (BBFC), where the film has been classified by that Board, or
b) By the licensing Authority where no classification certificate has been granted by the BBFC, or, where the licensing authority has notified the licence holder that section 20 (3) (b) (74 (3)(b) for clubs) of the Licensing Act 2003 applies to the film.
Permitted Hours - On Licence
Alcohol shall not be sold or supplied except during permitted hours.
The above restrictions do not prohibit:
a) consumption of the alcohol on the premises by, or, the taking, sale or supply of alcohol to any person residing in the licensed premises;
b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
c) the sale of alcohol to a trader or club for the purposes of the trade or club;
d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
e) the taking of alcohol from the premises by a person residing there; or
f) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
g) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Conditions Agreed with Environmental Health
1. The performance of amplified music shall be no louder than the background level of noise at the boundary of neighbouring residential properties and is to be inaudible at the boundary of neighbouring properties after 2300 hours.
2. All external doors and windows must be kept closed in all rooms when events involving amplified music or speech are taking place, other than for access and egress. It may be necessary to install mechanical extract ventilation or air conditioning for use during warm weather. Openings, including those for extract and ventilation purposes, in the external fabric of the premises may have to be acoustically sealed to the satisfaction of the licensing authority.
3. The external seating area is not to be used after 00:00 hours
4. Clear and prominent notices shall be displayed at all exits and in external seating areas requesting customers to respect the needs of local residents and leave the premises and area quietly.
5. The licensee will ensure that
a) Temporary electrical wiring and distribution systems are not used without prior inspection by a suitable qualified electrician.
b) Temporary electrical wiring and distribution systems shall comply with the recommendations of BS 7671 or where applicable BS 7909
c) Where they have not been installed by a competent person, temporary electrical wiring and distribution systems are to be inspected and certified by a competent person before they are put to use.
d) Entertainment equipment shall be fitted with a 30mAmp RCD (residual current device)
6. The licensee will ensure that an adequate and appropriate supply of first aid equipment and materials is available on the premises.
7. The licensee should advise Melton Borough Council as to the intended maximum capacity at the premises. This has been advised to be 440.
Conditions Agreed with Leicestershire Constabulary
1. The licensee will maintain membership of the local Pubwatch scheme including a radio link to CCTV.
2. The licensee will ensure that CCTV is installed following advice from the Leicestershire Constabulary Crime Reduction Officer and maintained in accordance with the Information Commissioner’s CCTV Code of Practice.
3. The licensee will ensure that no customers shall take glasses, cans or open bottles from the premises.
4. The licensee will employ sufficient registered door staff to deal with any likely contingency and each such individual must be licensed by the Security Industry Authority.
Conditions Consistent with Applicant’s Operating Schedule
The Prevention of Crime and Disorder
1. Any person exercising a security activity (as defined by paragraph 2(1)(a) of schedule 2 of the Private Security Industry Act 2001) shall be licensed by the Security Industry Authority.
2. Such a person will be employed at the premises at the discretion of the designated premises supervisor/holder of the Premises Licence.
3. Any such person referred to in condition (1) shall be linked by means of text or radio pager to the Police enabling the Police to be alerted to instances of crime and/or disorder (where required).
4. Any person as defined in condition (1) will clearly display his name badge at all times whilst on duty.
5. No customers apparently carrying open bottles upon entry shall be admitted to the premises at any times the premises are open to the public.
6. Where CCTV is installed with recording facilities such recordings shall be retained for a period of 30 days and made available within a reasonable time upon request by the Police.
7. Toughened glass shall be used for draft beer and lager at all times the premises are open to the public.
8. Alcoholic and other drinks may not be removed from the premises in open containers save for consumption in any external area provided for that purpose.
Public Safety
1. To comply with the reasonable requirements of the Fire Officer from time to time.
2. To comply with the reasonable requirements of the Building Control Officer.
The Prevention of Public Nuisance
1. Prominent, clear and legible notices shall be displayed at all exits requesting the public respect the needs of local residents and to leave the premises and area quietly.
2. Noise or vibration shall not emanate from the premises so as to cause a nuisance to nearby properties.
The Protection of Children from Harm
1. Children under the age of 16 shall not be permitted to enter the premises after 19:00.
