Licence Conditions
Mandatory conditions where licence authorises supply of alcohol
(1) No supply of alcohol may be made under the premises licence-
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Credit sales - Embedded Restriction
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;
b) for consumption by a person residing in the premises or his guest and paid for together with his accommodation;
c) to a canteen or mess.
Permitted Hours - On Licence
Alcohol shall not be sold or supplied except during permitted hours.
The above restrictions do not prohibit:
a) consumption of the alcohol on the premises by, or, the taking, sale or supply of alcohol to any person residing in the licensed premises;
b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
c) the sale of alcohol to a trader or club for the purposes of the trade or club;
d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
e) the taking of alcohol from the premises by a person residing there; or
f) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
g) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Conditions Agreed with Environmental Health
Music is not to be audible at the boundary of nearby residential properties after 22.00 hours. Failure to achieve audibility will require a noise limiting device. The noise limiting device shall be installed, fitted and maintained in such a manner as to control all sources of amplified music at the premises. Once set such a device should be inaccessible to the licensee or his staff.
Clear and prominent notices shall be displayed at all exits, in external seating areas and car park requesting customers to respect the needs of local residents and leave the premises and area quietly.
The external seating areas must not be used by customers after 2330 hours.
The licensee will ensure that
a) Temporary electrical wiring and distribution systems are not used without prior inspection by a suitable qualified electrician.
b) Temporary electrical wiring and distribution systems shall comply with the recommendations of BS 7671 or where applicable BS 7909
c) Where they have not been installed by a competent person, temporary electrical wiring and distribution systems are to be inspected and certified by a competent person before they are put to use.
d) Entertainment equipment shall be fitted with a 30mAmp RCD (residual current device)
The licensee will ensure that an adequate and appropriate supply of first aid equipment and materials is available on the premises.
The licensee should advise Melton Borough Council as to the intended maximum capacity at the premises.
Conditions Imposed by Licensing Committee
There will be provided at the rear of the premises an adequate supply of parking required by any event with a minimum of 50 parking spaces and there will be adequate signage on the premises to direct customers to the car park area.
The landlord and all staff working on the premises will be aware of and comply with all Codes and Guidance issued by the Portman Group.
Conditions Consistent with Applicant’s Operating Schedule
General
The variations proposed do not substantially alter the nature of the operation of these premises and, in line with section 5.50 of the Guidance, we will continue to manage the premises in a manner that promotes all four licensing objectives
We will continue to operate these premises in line with all relevant legislation.
The Prevention of crime and disorder
No alcoholic drinks are served to under 18s and in any instances of doubt over the age of a customer, proof of age is demanded
We operate to the BBPA code on drinks promotions
The variations proposed do not substantially alter the nature of the operation of these premises and, in line with section 5.50 of the Guidance, we will continue to manage the premises in a manner that promotes the prevention of crime and disorder
We will continue to operate these premises in line with all relevant legislation
We operate to the Portman Group Code of Practice on promoting responsible drinking
Public Safety
The variations proposed do not substantially alter the nature of the operation of these premises and, in line with section 5.50 of the Guidance, we will continue to manage the premises in a manner that promotes public safety
We will continue to operate these premises in line with all relevant legislation, including the Health & Safety Act 1974, Food Safety Act 1990, Fire Precautions Regulations 1997 & Disability Discrimination Act 1995 and associated regulations
These premises are adequately equipped with seating for the majority of customers
The prevention of public nuisance
The variations proposed do not substantially alter the nature of the operation of these premises and, in line with section 5.50 of the Guidance, we will continue to manage the premises in a manner that promotes the prevention of public nuisance
We will continue to operate these premises in line with all relevant legislation, including the Environmental Protection Act 1990
The protection of children from harm
No alcoholic drinks are served to under 18’s and in any instances of doubt over the age of a customer, proof of age is demanded
We have a policy of prohibiting persons under 18 from playing AWPs
We operate to the Portman Group Code of Practice on promoting responsible drinking
The operation and nature of these premises is of a style suitable for the admittance of children and we will manage the premises in a manner that promotes the protection of children from harm and in line with all relevant legislation.
