Additional Non-Standard Timings for Licensable Activities
To permit the premises to open for licensable activities to show the broadcast of televised sporting events of national or international interest outside normal operating hours, such opening times for this purpose to be confirmed upon 7 days prior notice in writing to the Police before the premises intend to open, such notification to include the opening times and the sporting event which is to be shown.
1. Mandatory conditions where licence authorises supply of alcohol
(1) No supply of alcohol may be made under the premises licence-
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
2. Mandatory Condition: Exhibition of Films
The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made
a) By the British Board of Film Classification (BBFC), where the film has been classified by that Board, or
b) By the licensing Authority where no classification certificate has been granted by the BBFC, or, where the licensing authority has notified the licence holder that section 20 (3) (b) (74 (3)(b) for clubs) of the Licensing Act 2003 applies to the film.
3. Permitted Hours - On Licence
Alcohol shall not be sold or supplied except during permitted hours.
The above restrictions do not prohibit:
a) consumption of the alcohol on the premises by, or, the taking, sale or supply of alcohol to any person residing in the licensed premises;
b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
c) the sale of alcohol to a trader or club for the purposes of the trade or club;
d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
e) the taking of alcohol from the premises by a person residing there; or
f) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
g) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
4. Conditions Agreed with Environmental Health
a) Music and amplified speech is not to be louder than the background level of noise at the boundary of residential properties and be inaudible at the boundary of nearby residential properties after 23.00 hours.
Failure to achieve inaudibility may require;
I. installation of acoustic enclosures to extraction and ventilation openings in the external fabric of the premises and/or
II. a noise limiting device. The noise limiting device shall be installed, fitted and maintained in such a manner as to control all sources of amplified music at the premises. Once set such a device should be inaccessible to the licensee or his staff and/or
III. installation of secondary double glazing
b) External doors and windows must be kept closed in all rooms when events involving amplified music or speech are taking place, other than for access and egress. It may be necessary to install mechanical extract ventilation or air conditioning for use during warm weather.
c) The external seating areas must not be used by customers after 2300 hours
d) Clear and prominent notices shall be displayed at all exits requesting customers to respect the needs of local residents and leave the premises and area quietly.
e) The licensee will ensure that
I. Temporary electrical wiring and distribution systems are not used without prior inspection by a suitable qualified electrician.
II. Temporary electrical wiring and distribution systems shall comply with the recommendations of BS 7671 or where applicable BS 7909
III. Where they have not been installed by a competent person, temporary electrical wiring and distribution systems are to be inspected and certified by a competent person before they are put to use.
IV. Entertainment equipment shall be fitted with a 30mAmp RCD (residual current device)
f) The licensee will ensure that an adequate and appropriate supply of first aid equipment and materials is available on the premises.
g) The licensee should advise Melton Borough Council as to the intended maximum capacity at the premises
5. Conditions Consistent with Applicant’s Operating Schedule
The Prevention of Crime and Disorder
a) Any person exercising a security activity (as defined by paragraph 2(1)(a) of schedule 2 of the Private Security Industry Act 2001) shall be licensed by the Security Industry Authority.
b) Such a person will be employed at the premises at the discretion of the designated premises supervisor/holder of the Premises Licence.
c) Any person as defined in condition (1) will clearly display his name badge at all times whilst on duty.
d) No customers apparently carrying open bottles upon entry shall be admitted to the premises at any times the premises are open to the public.
e) Where CCTV is installed with recording facilities such recordings shall be retained for a period of 30 days and made available within a reasonable time upon request by the Police.
f) Alcoholic and other drinks may not be removed from the premises in open containers save for consumption in any external area provided for that purpose.
Public safety
g) To comply with the reasonable requirements of the Fire Officer from time to time.
h) To comply with the reasonable requirements of the Building Control Officer.
The Prevention of Public Nuisance
i) Where appropriate, prominent, clear and legible notices shall be displayed at all exits requesting the public respect the needs of local residents and to leave the premises and area quietly.
j) Noise or vibration shall not emanate from the premises so as to cause a nuisance to nearby properties.
The Protection of Children from Harm
k) Children under the age of 16 shall not be permitted to enter the premises after 9pm.
l) No films or videos of any description will be shown so that they can be viewed by persons under the age of any applicable BBFC/Local Authority certification.
m) The restrictions set out in the Licensing Act 2003 will apply. No unusual or additional risks of harm to children have been identified.
