Mandatory conditions where licence authorises supply of alcohol
(1) No supply of alcohol may be made under the premises licence-
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Credit sales - Embedded Restriction
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;
b) for consumption by a person residing in the premises or his guest and paid for together with his accommodation;
c) to a canteen or mess.
On Licence - Embedded Restriction
Alcohol shall not be sold or supplied unless suitable beverages other than alcohol (including drinking water) are equally available for consumption with or otherwise as an ancillary to meals served in the premises.
The licensee may also provide and permit the consumption of late night refreshment for a period of 30 minutes after the permitted hours set out above
Permitted Hours - On Licence
Alcohol shall not be sold or supplied except during permitted hours.
The above restrictions do not prohibit:
a) the taking of the alcohol from the premises, (unless the alcohol is supplied or taken in an open vessel,) during the first twenty minutes after the above hours;
b) the consumption of the alcohol on the premises by persons taking meals there during the first thirty minutes after the above hours, if the alcohol was supplied for consumption ancillary to those meals;
c) consumption of the alcohol on the premises by, or, the taking, sale or supply of alcohol to any person residing in the licensed premises;
d) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
e) the sale of alcohol to a trader or club for the purposes of the trade or club;
f) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
g) the taking of alcohol from the premises by a person residing there; or
h) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
i) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Conditions Agreed with Environmental Health
Music and amplified speech is not to be louder than the background level of noise at the boundary of residential properties and be inaudible at the boundary of nearby residential properties after 23.00 hours.
Failure to achieve inaudibility may require;
installation of acoustic enclosures to extraction and ventilation openings in the external fabric of the premises and/or
a noise limiting device. The noise limiting device shall be installed, fitted and maintained in such a manner as to control all sources of amplified music at the premises. Once set such a device should be inaccessible to the licensee or his staff
any other steps appropriate to achieve the above
Clear and prominent notices shall be displayed at all exits requesting customers to respect the needs of local residents and leave the premises and area quietly.
Any external seating areas must not be used by customers after 2300 hours.
The licensee will ensure that
a) Temporary electrical wiring and distribution systems are not used without prior inspection by a suitable qualified electrician.
b) Temporary electrical wiring and distribution systems shall comply with the recommendations of BS 7671 or where applicable BS 7909
c) Where they have not been installed by a competent person, temporary electrical wiring and distribution systems are to be inspected and certified by a competent person before they are put to use.
d) Entertainment equipment shall be fitted with a 30mAmp RCD (residual current device)
The licensee will ensure that an adequate and appropriate supply of first aid equipment and materials is available on the premises.
Conditions Agreed with Leicestershire Constabulary
The licensee will maintain membership of the local Pubwatch scheme including a radio link to CCTV.
The licensee will ensure that no customers shall take glasses, cans or open bottles from the premises.
A Personal Licence holder will be present on the premises throughout opening hours with the exception of reasonable holidays and sickness.
Conditions Consistent with Applicant’s Operating Schedule
General
Following an assessment of the premises and its surrounding area the following are proposed:
30 minute “drinking up” time will allow appropriate dispersal, use of lavatories etc.
In order to further the licensing objectives the licensee reserves the right to move the fire appliances, AWP machines, cigarette machines and or any other similar objects temporarily in a fixed location which may impact on the ability of individuals on the premises to use exits or escape routes without impediment.
The Prevention of Crime and Disorder
Illumination is provided to the exterior areas of the pub.
All interior areas within the pub are visible from the central bar servery.
CCTV monitors the exterior.
The toilets are checked regularly
Burglar alarm in operation.
Drugs are not tolerated on the premises.
Minimum of 2 staff on duty at busy times.
The licensee and staff monitor customers at all times. Soft drinks are available for drivers.
Most of clientele is local.
Public Safety
The pub is equipped with emergency lighting and exit signs. All the fire fighting equipment is serviced annually (contract is with Rosedale Fire Limited). Door controls on Friday and Saturday nights, supervised directly by the licensees. Extractor fans (5) in operation. Licensed taxi service is available immediately outside the premises.
The Prevention of Public Nuisance
All entrance doors have internal lobbies, noise survey is carried out regularly to ensure no noise pollution, cellar cooling is in a position not to cause a nuisance, no residential accommodation in the immediate area. When customers leave they are required to do so by the front door only which empties out away from any residential dwelling. At weekends music will be switched off one hour before the end of alcohol service to facilitate a gradual wind down of business.
The Protection of Children from Harm
No unaccompanied children are allowed on the premises at any time.
No children are permitted after 8pm. Children are not permitted to stand at the bar. The AWP and cigarette machine are adjacent to each another and close to the bar counter and therefore easily observed. Sign above cigarette machine clearly states not to be used by anyone under 16 years of age.
