Mandatory conditions where licence authorises supply of alcohol
(1) No supply of alcohol may be made under the premises licence-
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Embedded Conditions
Permitted Hours - On Licence
Alcohol shall not be sold or supplied except during permitted hours.
The above restrictions do not prohibit:
a) consumption of the alcohol on the premises by, or, the taking, sale or supply of alcohol to any person residing in the licensed premises;
b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
c) the sale of alcohol to a trader or club for the purposes of the trade or club;
d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
e) the taking of alcohol from the premises by a person residing there; or
f) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
g) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Entertainment - Embedded Restriction
Where the number of children attending the entertainment exceeds 100 the licensee shall ensure that the provisions of Section 12 of the Children and Young Persons Act 1933 are complied with.
This licence is also subject to the attached Public Entertainment Conditions
Public Entertainment Maximum Occupancy
The maximum occupancy at the premises shall not exceed 250
Conditions Agreed with Environmental Health
Recorded music is not to be louder than the background level of noise at the boundary of nearby residential properties and be inaudible at the boundary of nearby residential properties after 23:00.
All external doors and windows must be kept closed in all rooms when events involving amplified music or speech are taking place, other than for access and egress. It may be necessary to install mechanical extract ventilation or air conditioning for use during warm weather. Openings, including those for extract and ventilation purposes, in the external fabric of the premises may have to be acoustically sealed to the satisfaction of the licensing authority.
The external seating areas must not be used by customers after 2300 hours
Clear and prominent notices shall be displayed at all exits, in external seating areas and car park requesting customers to respect the needs of local residents and leave the premises and area quietly.
The licensee will ensure that an adequate and appropriate supply of first aid equipment and materials is available on the premises.
Conditions Consistent with Applicant's Operating Schedule
General
The premises will respect Spirit Group’s Approach to Responsible Drinking. Our policies change at regular intervals to reflect current trends and it would be inappropriate to standardise them on a permanent basis.
The Prevention of Crime and Disorder
When door staff are used they will be Security Industry Authority (SIA) approved and operate in accordance with the Security Industry guidelines.
A zero tolerance towards illegal drugs will be enforced at all times.
If a disc jockey is used on any night then he/she will ask customers to leave quietly.
If a CCTV system is installed at this site, it will continue to operate during the additional hours of trading and notices will be displayed.
All instances of crime and disorder will be reported to the Police and will be kept in a incident log book.
Public Safety
Public safety is integral to the way that the Spirit Group runs its business and is reviewed regularly through our health and safety policy. This policy is briefed and trained to all management and staff and we will continue to train our staff to the standards required by relevant legislation.
Free drinking water will be available at all times.
The Prevention of Public Nuisance
Additional patrols will take place by members of staff, internally and externally, limit to limit any noise pollution when entertainment is being offered within the premises.
If appropriate, notices will be displayed asking our customers to respect our neighbours when leaving the premises.
Where already used text/radio pagers will continue to be used for the additional hours of trading and will be monitored by a responsible member of staff.
Soft drinks and non-alcoholic refreshment will be available if we decide to use the option to stay open for an extended period between the cessation of the supply of alcohol and the closure of the premises.
The Protection of Children from Harm
When children are allowed upon the premises, any entertainment offered within the premises will be suitable for young persons.
Children will be required to be supervised by the accompanying adult at all times.
A no smoking area will be provided.
Soft drinks and non-alcoholic drinks will be available.
A recognised proof of age policy will be enforced.
